1. Prohibited Items and Goods (The Prohibited List)
The following goods are strictly prohibited from being listed, advertised, or sold on SWIVEL, as they are illegal, highly restricted, or pose a significant safety risk.
A. Illegal, Highly Restricted, and Hazardous Items
Illegal Drugs & Narcotics
All controlled substances, illegal drugs, and drug paraphernalia. Narcotics, opioids, illegal synthetic substances, and products marketed to mimic illegal drug effects.
Firearms, Weapons, & Explosives
Firearms, ammunition, firearm parts, explosives, pyrotechnics, hazardous materials, and dangerous weapons (e.g., knuckle dusters, switchblades, Tasers, pepper spray).
Alcohol & Tobacco
All alcoholic beverages and tobacco products, including cigarettes, cigars, chewing tobacco, and nicotine-containing vape products and e-juices.
Prescription & OTC Drugs
All prescription-only pharmaceuticals and medicines, and over-the-counter medicines. Unauthorized health supplements with false claims are also prohibited.
Human & Wildlife Products
Human remains, body parts or fluids, and products derived from endangered or protected flora or fauna.
Counterfeit & Infringing Goods
Fake, replica, or counterfeit goods that infringe on third-party intellectual property, including unauthorized copies of software, music, or licensed materials.
B. Other Prohibited Content and Services
- Offensive Content: Items or content that promote hatred, racism, violence, discrimination, or religious persecution.
- Illegal Acts: Items that facilitate illegal activity, such as hacking tools or instructions for manufacturing restricted goods.
- Stolen/Illegal Goods: Any goods that are stolen or illegally acquired.
- Financial/Investment Schemes: Listings for get-rich-quick schemes or MLM programs that primarily benefit recruitment over product sales.
2. Content Moderation Standards
- Accuracy: Product descriptions must be truthful and not contain misleading claims about safety, efficacy, or origin.
- Safety: Content must not promote unsafe practices or encourage misuse that could lead to injury.
- Decency: Sexually explicit, pornographic, or graphically violent content is prohibited.
- Intellectual Property: Users must have the legal right to use all text and images they upload.
3. Enforcement and Penalties for Violation
SWIVEL is committed to maintaining a safe and lawful marketplace. Violations of this policy will result in action.
A. Penalty for Major Violations (Prohibited Items)
Any instance of listing, advertising, or selling a Prohibited Item will trigger the following:
- Automatic Account Termination: Accounts involved will be immediately and permanently terminated.
- Withholding of Funds: Outstanding or pending payments to the offending vendor may be frozen and withheld.
- Legal Referral: Violations involving items illegal under national law may be referred to law enforcement with user information and transaction history.
- No Appeal: Decisions regarding Prohibited Items are final and not subject to appeal.
B. First-Level Violations
For minor infractions (e.g., poor labelling or minor inaccuracies):
- The violating listing will be immediately removed.
- The user will receive a formal warning. Repeated first-level violations may lead to account suspension.
