1. Prohibited Items and Goods (The Prohibited List)
The following goods are strictly prohibited from being listed, advertised, or sold on Swivel, as they are illegal, highly restricted, or pose a significant safety risk.
A. Illegal, Highly Restricted, and Hazardous Items
Illegal Drugs and Narcotics
All controlled substances, illegal drugs, and drug paraphernalia. Narcotics, opioids, illegal synthetic substances, and products marketed to mimic illegal drug effects.
Firearms, Weapons, and Explosives
Firearms, ammunition, firearm parts, explosives, pyrotechnics, hazardous materials, and dangerous weapons (e.g., knuckle dusters, switchblades, tasers, pepper spray).
Alcohol and Tobacco
All alcoholic beverages and tobacco products, including cigarettes, cigars, chewing tobacco, and nicotine-containing vape products and e-juices.
Prescription and OTC Drugs
All prescription-only pharmaceuticals and medicines, and over-the-counter medicines. Unauthorized health supplements with false claims are also prohibited.
Human and Wildlife Products
Human remains, body parts or fluids, and products derived from endangered or protected flora or fauna.
Counterfeit and Infringing Goods
Fake, replica, or counterfeit goods that infringe on third-party intellectual property, including unauthorized copies of software, music, or licensed materials.
B. Other Prohibited Content and Services
- Offensive content that promotes hatred, racism, violence, discrimination, or religious persecution.
- Items that facilitate illegal activity, such as hacking tools or instructions for manufacturing restricted goods.
- Stolen or illegally acquired goods.
- Financial or investment schemes that primarily benefit recruitment over product sales.
- Adult or sexually explicit content, graphic violence, or exploitative content.
2. Content Moderation Standards
- Accuracy: Listings must be truthful and not misleading about safety, efficacy, or origin.
- Safety: Content must not promote unsafe practices or encourage misuse.
- Decency: Pornographic or graphically violent content is prohibited.
- Intellectual Property: Users must have rights to the text and images they upload.
- Privacy: No posting of personal data or private contact details without consent.
We also prohibit content that attempts to bypass platform rules, such as asking users to pay outside Swivel or providing off-platform contact details in listings.
3. Reporting and Review
Users can report content using in-app reporting or by contacting support. We review reports and may remove or restrict content, suspend accounts, or request additional information.
We use a combination of automated signals, user reports, and manual review to identify potential violations. We prioritize safety-related reports for faster review.
4. Intellectual Property Takedown Requests
If you believe content infringes your intellectual property, send a notice with: (1) your contact information, (2) a description of the work, (3) the URL or listing ID, (4) a statement of good faith belief, and (5) a statement that the notice is accurate. We may remove or disable access to the content while we investigate.
If the user provides a counter-notice or additional evidence, we may restore content if appropriate and lawful.
5. Enforcement and Penalties
Swivel is committed to maintaining a safe and lawful marketplace. Violations of this policy will result in action.
A. Major Violations (Prohibited Items)
Any instance of listing, advertising, or selling a Prohibited Item may trigger:
- Account termination: Accounts may be immediately terminated.
- Withholding of funds: Pending payments may be frozen for investigation.
- Legal referral: Illegal activity may be referred to law enforcement.
B. Minor Violations
For minor infractions (e.g., inaccurate listings):
- The listing may be removed or edited.
- The user may receive a warning or temporary suspension.
6. Appeals
If you believe content was removed in error, you may appeal by contacting support with your listing ID and reason for appeal.
We review appeals in good faith and may request additional information. Repeat offenders may be subject to stricter enforcement.
